Cleanup of the nation’s worst toxic
waste sites is "far behind", a leading environmental
expert told a global internet audience today. Zoltan C. Mester,
President of ZKM Consultants, Laguna Niguel, Ca., said new
legislation is urgently needed to accelerate work on the National
Priority List. Mester was a guest on "The National Property
Management Roundtable" over www.Talk2k.com.
"The average annual cost for treating toxic dumps and other
such sites has been only $1.5 billion, and that money is not spent
effectively" Mester told Roundtable host, Bob Warren. "We
need significant amendments to the existing 1980 CERCLA (Super Fund)
Act to permit faster funding and provide a fast track to applicants
responsible for clean ups of contaminated sites." Mester was
referring to property owners and others in the chain of
responsibility for clean up. These persons are often stymied and
delayed by the "harsh legalities" under CERCLA’s strict,
joint and several statutory requirements. The last major change to
CERCLA was the Superfund Amendments and Reauthorization Act (SARA)
in 1986 that changed little in the statutory requirements for the
original CERCLA regarding cleanups. Mester said "The time is
ripe now to overhaul the Superfund."
